RESIDENTIAL SUBLEASE AGREEMENT This Sublease Agreement (this "Sublease") is made and entered into as of November 1, 2024, by and between: Sublessor (Current Tenant): David Miller Subtenant: Sarah Jenkins Original Master Landlord: Highland Heights Real Estate LLC 1. PREMISES Sublessor agrees to sublease to Subtenant, and Subtenant agrees to sublease from Sublessor, the premises located at: 742 Evergreen Terrace, Apt 4B, Austin, TX 78701 (the "Subleased Premises"). 2. TERM The term of this Sublease shall commence on December 1, 2024 and shall terminate on May 31, 2025 (the "Sublease Term"), unless sooner terminated pursuant to the terms hereof or the Master Lease. 3. MASTER LEASE INCORPORATION This Sublease is subject and subordinate to all terms, covenants, and restrictions contained in that certain Master Lease between Sublessor and Master Landlord. Subtenant agrees to assume and faithfully perform all duties, covenants, and restrictions of the tenant under the Master Lease as applied to the Subleased Premises. 4. RENT PAYMENTS Subtenant shall pay to Sublessor a monthly rental amount of $1,850 due on or before the first (1st) day of each calendar month. Payments shall be made via electronic transfer or as otherwise mutually designated in writing. 5. SECURITY DEPOSIT Upon the execution of this Sublease, Subtenant shall deposit with Sublessor the sum of $1,850 as security for the full and faithful performance of Subtenant's obligations. Within thirty (30) days following the termination of this Sublease and full surrender of possession, Sublessor shall return the deposit less any lawful deductions for damages beyond ordinary wear and tear. 6. UTILITIES AND SERVICES Subtenant shall be solely responsible for setting up and paying all monthly utility services directly, including electricity, gas, water, internet, and trash. 7. USE AND CARE OF PREMISES The Subleased Premises shall be used strictly for residential purposes in compliance with all local zoning laws, municipal ordinances, and building regulations. No alterations, painting, or modifications shall be made without prior written consent of both Sublessor and Master Landlord. 8. LANDLORD CONSENT This Sublease is explicitly conditioned upon obtaining the formal written consent of Master Landlord (Highland Heights Real Estate LLC), if required under the terms of the Master Lease. 9. GOVERNING LAW This Sublease shall be construed, interpreted, and governed under the laws of the State of Texas.
