Frequently Asked Questions
What makes a Power of Attorney 'Durable'?
A standard Power of Attorney automatically terminates if the principal becomes incapacitated. A 'Durable' Power of Attorney contains specific statutory language stating that the agent's authority continues uninterrupted even if the principal becomes mentally incompetent or physically incapacitated.
Does a Power of Attorney remain effective after death?
No. All Power of Attorney authority ceases immediately upon the death of the principal. After death, the management of the estate transfers exclusively to the executor named in the principal's Last Will and Testament or an administrator appointed by probate court.
Does a Power of Attorney need to be notarized?
Yes. Financial institutions, title companies, and government agencies (including the IRS) virtually always require a Power of Attorney to be notarized and witnessed before they will honor the agent's signature.
Can the agent use the principal's money for themselves?
No. The agent has a strict fiduciary duty under the law to act exclusively in the best interest of the principal. Using the principal's funds for personal benefit without explicit written authorization constitutes breach of fiduciary duty and is punishable by law.
