Frequently Asked Questions

What is the difference between a new lease and a lease renewal agreement?

A lease renewal agreement (or lease extension) is an addendum that references an existing lease and updates key terms like dates and rent, keeping all other original rules in place. A new lease replaces the previous agreement entirely and requires renegotiating every single clause.

How far in advance should a lease renewal be signed?

Most landlords send renewal proposals 60 to 90 days before the existing lease expires. This gives both parties adequate time to negotiate and ensures that if the tenant chooses not to renew, the landlord has sufficient notice to market the property.

Can a landlord raise the rent upon renewal?

Yes, unless the property is governed by local rent control or stabilization ordinances. The lease renewal agreement specifies the new rent amount, which takes effect on the first day of the renewed term.

What happens if a lease expires without a renewal agreement?

In most jurisdictions, if a fixed-term lease expires and the tenant continues paying rent with the landlord's acceptance, the tenancy automatically converts into a month-to-month tenancy under the terms of the original lease.
